Terms of Service

These Terms of Service govern access to and use of the BizBlasts website, software, booking platform, payment processing, dashboard, and related services. By using the service, you agree to these terms.

Effective date: June 1, 2026

1. Agreement and Eligibility

These Terms form a binding agreement between you and BizBlasts. If you use the service on behalf of a company or other entity, you represent that you have authority to bind that entity, and references to “you” include that entity.

You may use the service only if you can form a binding contract and your use complies with applicable laws.

2. The Service

BizBlasts provides tools that help businesses run their public-facing operations online, including professional websites, online booking and scheduling, online product and service ordering, payment processing, customer management, transactional email and SMS, marketing automation, custom-domain hosting, and related dashboards and infrastructure. Features vary by subscription tier and may change over time.

3. Accounts and Security

You are responsible for the accuracy of account information, the security of account credentials, and all activity that occurs under your account. You must promptly notify us of any unauthorized use or security incident affecting your account, your business workspace, or the data you process through it.

4. Customer Responsibilities

You are responsible for:

  • All content, products, services, prices, availability, prompts, knowledge-base material, workflows, and communications you or your users submit to the service.
  • Obtaining any rights, notices, and consents required to contact your customers or process their information, including marketing emails and SMS.
  • Compliance with laws applicable to your business, including consumer protection, privacy, telemarketing, TCPA, anti-spam, call-recording, marketing, tax, sector-specific, and licensing rules.
  • Fulfilling the goods and services you sell through the platform, including delivery, scheduling, customer support, refunds, returns, and disputes with your customers.
  • Configuring booking policies, cancellation rules, deposits, tips, shipping options, taxes, and any other commerce settings that match how your business actually operates.
  • Maintaining a human point of contact for your customers and meeting any escalation requirements that apply to your industry.

5. Prohibited Uses

You may not use the service to:

  • Violate law, infringe rights, or engage in fraud, deception, harassment, or harmful conduct.
  • Send unlawful spam, place unlawful robocalls, or contact recipients without the consent your jurisdiction requires.
  • Sell goods or services that are illegal where the transaction takes place, or that our payment processor prohibits (for example, regulated goods on Stripe’s restricted list).
  • Process or transmit highly sensitive data (such as protected health information, payment card data outside of our hosted payment flow, or government identifiers) where the service is not designed or approved for that purpose.
  • Reverse engineer, interfere with, disrupt, or bypass security, rate limits, multi-tenant isolation, or usage limits of the service.
  • Use the service to build or benchmark a competing product, except to the extent prohibited by law.

6. Bookings, Orders, and Customer Interactions

BizBlasts is a software platform. When a customer books an appointment, orders a product, or pays a deposit through your BizBlasts site, the transaction is between you and that customer. We provide the software, hosting, communications, and payment plumbing, but you are the merchant of record for the goods and services you sell.

You agree to clearly disclose your business name, contact information, pricing, fulfillment timelines, cancellation rules, and any required notices to your customers.

7. Messaging, Calling, and Consent

If you use the platform’s SMS, email, or calling features, you are solely responsible for ensuring you have all legally required consents, disclosures, and opt-out mechanisms for the recipients you contact. You must honor recipient preferences and maintain practices consistent with applicable telecom, anti-spam, and marketing laws.

Standard carrier rules, message and data rates, throughput limits, and third-party platform policies may apply.

8. Payment Processing

Payments collected through BizBlasts are processed by our payment provider (currently Stripe). To accept payments you must complete the provider’s onboarding and agree to its connected-account terms. Funds are disbursed by the payment provider to the bank account you connect, subject to their schedule, holds, and reserves.

BizBlasts may charge platform fees, transaction fees, or subscription fees as described on our website, in your dashboard, or in a separate written agreement. Payment-processor fees are charged in addition to any BizBlasts fees.

9. Fees, Billing, and Renewals

Paid BizBlasts subscriptions are billed in advance according to the plan and billing period you select. By purchasing a subscription, you authorize us and our payment processor to charge the applicable fees, taxes, and any renewal charges using your selected payment method.

Unless otherwise stated in writing, subscriptions automatically renew at the end of the applicable billing period until canceled. Pricing, included usage, and plan features may vary by tier and may be updated prospectively.

Custom domain hosting, additional SMS volume, additional storage, and other premium features may be included with certain tiers or billed separately. See your dashboard for current pricing and limits.

10. Refunds and Cancellations

Except as required by law or expressly stated in writing, BizBlasts subscription fees and one-time service fees are non-refundable. We may offer specific promotional refund terms from time to time; any such offer is limited to its stated terms and may be denied for abuse, fraud, repeated refund requests, or material violation of these Terms.

Refunds for goods or services sold by you through BizBlasts are between you and your customer. See our Return Policy for additional detail on platform-level refunds.

11. Suspension and Termination

We may suspend or terminate access to the service, in whole or in part, if we reasonably believe you have violated these Terms, created legal or security risk, failed to pay amounts due, or used the service in a way that could harm us, the platform, your customers, or others.

You may stop using the service at any time and cancel your subscription from your dashboard. Termination does not relieve you of payment obligations already incurred. On termination, custom domains may stop resolving to your site, scheduled communications may stop sending, and access to hosted assets may be revoked.

12. Intellectual Property

BizBlasts and its licensors retain all rights, title, and interest in the service, including the software, design, branding, documentation, and underlying technology. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service during your subscription term.

You retain rights in content you submit (such as your website copy, product photos, business memory, and customer data), but you grant us and our service providers a worldwide, limited license to host, use, process, reproduce, transmit, and display that content as necessary to operate, support, secure, and improve the service.

13. Confidentiality

Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and use it only as needed to perform under these Terms, except where disclosure is required by law.

14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZBLASTS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the service will be uninterrupted, error-free, or completely secure, that any data will never be lost, or that any specific outcome (such as bookings, sales, search ranking, or domain certificate issuance) will be achieved.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZBLASTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZBLASTS’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO BIZBLASTS FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

16. Indemnification

You will defend, indemnify, and hold harmless BizBlasts and its affiliates, officers, directors, employees, and agents from and against third-party claims, damages, liabilities, losses, and expenses, including reasonable attorneys’ fees, arising from your content, your products and services, your use of the service, your communications with your customers, or your violation of these Terms or applicable law.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules, unless applicable law requires otherwise. The state or federal courts located in Arizona will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the service, and each party consents to those courts and venues.

18. Changes to the Service or Terms

We may modify the service or these Terms from time to time. If we make material changes, we may provide notice by posting an updated version on the site, updating the effective date, sending an in-app or email notice, or using other reasonable means. Continued use of the service after the changes take effect constitutes acceptance.

19. General

These Terms, together with our Privacy Policy, Acceptable Use Policy, Return Policy, Shipping Policy, Cookies Policy, Disclaimer, and any additional written terms we provide for specific services, are the entire agreement between you and BizBlasts regarding the service. If any provision is held unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver.
